PARKER’S RACEWAY – WAIVER OF LIABLITY – SPECTATORS
Parker’s Raceway, Ltd. permits entry to spectators at its motor racetrack premises located at Breakers, Grand Cayman (“Parker’s Raceway”) on the following terms and conditions:
- You understand and acknowledge that entering upon, watching or spectating at motorsports events, carries with it the risk and potential for serious personal injury or death.
- You agree to assume and accept all such risk and potential for personal injury, or death, loss or damage, including to personal property and chattels, which you may incur as a result of your entry upon Parker’s Raceway and attendance as a spectator at motorsports events, and you hereby release, waive and covenant not to sue, and further agree to indemnify, defend and hold harmless the following parties; Parker’s Raceway, Ltd., PTO Ltd., JRC Investments Ltd., their respective officers, directors and shareholders, and the organizers, promoters, sponsors, advertisers, volunteers, race track staff and officials, with respect to any liability, claims, demands, causes of action, you may have arising from your attendance at motorsports events at Parker’s Raceway, including loss or damage to any motor vehicle or its contents, and including claims for liability caused in whole or in part by the negligence of the aforementioned parties.
- You further agree that you will not maintain any action or proceeding against any person, firm or corporation in which will or may arise a claim for contribution against any of the aforementioned parties. If, despite this Agreement, you or anyone on your behalf, makes a claim of liability against any of the aforementioned parties, you will indemnify, defend and hold harmless each of them, including as to their legal costs and attorneys’ fees on the indemnity basis.
- You agree to abide by all rules and regulations applicable to spectators established by Parker’s Raceway, Ltd. for motorsports event, and as may be amended and posted in writing from time to time, including as to parking, and including any directions or instructions provided by staff and officials at Parker’s Raceway.
You understand that the Event is subject to photography and/or audio-video recording by or on behalf of the parties referred to above, and you agree and consent to the recording of my image and voice, whether in analog or digital form and you authorize these parties aforesaid making the recordings to edit, alter, copy, exhibit, publish, or distribute these recordings including digitally by way of the internet, and by way of social or other electronic media, and without payment or other consideration to me, for the purpose of promotion of Parker’s Raceway, and you waive (i) any right to inspect or approve the finished product wherein your voice or image appears, (ii)
