The EventPro fees are nonrefundable, fees will not be refunded to the ticket buyer or waived to event organizer when a refund is processed unless an Insurance package is purchased prior to checkout and after a successful insurance claim. There are two exceptions. We will refund the fees to buyers when an event is cancelled and you have purchased an insurance package or when the buyer was charged multiple times in error and requests a refund within 3 days of purchase.

All Approved Refunds are subject to a 5% processing fee.

Refunds requests must come from the Event Organizer or in event of postponement with refund authorization, an e-mail must be sent from the e-mail address used to complete the purchase to [email protected] with the subject line "(EVENT NAME) Refund Request". Please also include the order number in e-mail body.

FRAUD PREVENTION AND VERIFICATION
We reserve the right to identify and flag any order that we reasonably believe presents a heightened risk of fraud, unauthorized use, resale abuse, chargebacks, or other payment irregularities. Flagged orders may be placed on hold and will require verification as a condition of entry and ticket validity.

Verification may include, without limitation: (a) presentation of a valid government issued photo ID that matches the purchaser name, (b) presentation of the payment card used for the purchase, and (c) confirmation of order details (including last four digits of the card, billing name, and the confirmation email).

If verification is not successfully completed, we may cancel the ticket(s) and refuse entry. In such cases, the order may be deemed void and non refundable, and any additional remedies available to us remain reserved.

TICKET RESALE

Reselling tickets on EventPro is not allowed. If you're considering purchasing from a third-party, remember it's safest to purchase tickets for EventPro listed events through the authorized event listing. EventPro can't verify or guarantee tickets sold outside of the authorised listing. Any tickets purchased from a Third-Party is done so at your own risk.

If payment has DEFAULTED, an automated email will be sent to the purchaser’s email address and a 10-day grace period offered to update payment information and submit payment. If defaulted payment is not received, the order will be canceled, and only 50% of funds collected will be refunded.

PERFORMERS/ARTISTS/ACTS/PLAYERS SUBJECT TO CHANGE

Performers, Artists, Acts, Players are subject to change or cancellation at any time without notice. No refund will be owed if any performer, artist, act, player or any other scheduled performance, person or group is changed or canceled and the event still occurs.

Cancellations EventPro And It's Third Party Event Organizers accepts no liability if an event is cancelled or postponed for reasons beyond our reasonable control resulting from an act of God, adverse weather conditions, epidemic, pandemic, governmental regulation, fire, war, terrorist activity or civil commotion.

Occasionally, events are canceled or postponed by the promoter, team, band or venue. Should this occur, we will attempt to contact you to inform you of refund or exchange procedures for that event if we have been made aware by the promoter, team, band or venue. For exact instructions on any canceled or postponed event, please check the event information online or contact us. If a refund is issued, then the Promoter will most likely give you a refund by issuing a credit to the credit card that you used to purchase that ticket, and the holder of the ticket will not be able to physically present it for a refund.

EventPro typically only offers refunds and/or exchanges based on the promoter's, team's or venue's instructions. EventPro is not obligated to issue a refund except to the extent that the promoter, team or venue responsible for bringing you the event (1) instructs us to issue a refund, and (2) provides us with the ticket funds necessary to issue refunds. In order to receive a refund or an exchange that may be offered, you will have to comply with the promoter's, team's or venue's instructions or deadlines, which, along with the decision about whether or not to issue a refund or an exchange, may be at the promoter's, team's or venue's discretion.

Biometric Screening, Attendance Technology & Facial Recognition Notice

Certain events sold through the EventPro platform may use automated camera-based screening and attendance technology ("EventPro Vision") at or near entrances and within event areas. Where this technology is deployed, by purchasing a ticket and/or entering the event, you acknowledge and agree to the following.

What may be collected. At select events, cameras may passively capture images of faces of persons entering or present at the event and convert them into numerical representations ("facial templates") for the purposes described below. Physical entry points and event zones where such technology is in use will be identified by on-site signage.

How it may be used. Where deployed, this technology may be used to: (a) count unique attendees and estimate attendance; (b) detect entry that does not correspond to a valid ticket check-in and identify potential ticketing fraud; (c) match captured faces against a limited list of individuals of interest to the event organizer (for example, persons previously removed from an event, or staff and security personnel excluded from attendance counts); and (d) reconcile attendance against ticket check-in records. Any match is advisory only, is reviewed by a person, and is not used to make automated decisions about your entry.

What is not done. This technology is not used for advertising, is not sold or shared with third parties for their own purposes, and captured images and facial templates are not linked to your name or identity except, where applicable, by reference to a ticket or order identifier for fraud-reconciliation purposes. Raw video is not retained.

Retention. Facial templates and any associated images are retained only for the duration of the event and a limited period thereafter for reconciliation and security purposes, and are then deleted in accordance with the organizer's data-retention practices and applicable law.

Your rights and choices. This processing is carried out in accordance with the Data Protection Act, 2021 (Cayman Islands) and other applicable law. You may have rights in respect of your personal data, including biometric data, and may contact the event organizer or EventPro to exercise them. If you do not wish to be subject to camera-based screening at an event where it is in use, please review the on-site signage and speak with event staff regarding available options before entering.

Consent. By purchasing a ticket to, and/or attending, an event where this technology is deployed, you consent to the collection and use of your biometric data as described in this notice and as further detailed in the EventPro Privacy Policy.

1. Who We Are.

1.1 EventPro.

Welcome to EventPro! EventPro is a registered business in the Cayman Islands with its principal place of business also being in the Cayman Islands (“EventPro,” “us,” “we” or “our”). We are a mobile ticketing and events management platform. Through our platform, mobile apps and services, we make selling tickets to your events a breeze!

1.2 The Services and Users.

EventPro’s websites and domains, including http://eventproapp.com and http://eventpro.ky, and all of the webpages, subdomains and subparts of those websites (collectively, our “Site”), all of the services available on or through the Site or otherwise provided by us (including our application programming interfaces), and all of our free mobile applications, including without limitation, the EventPro app and mobile Scanner app (collectively, the “Applications”) are offered, maintained and provided by EventPro (Cayman Islands). By using the website and the applications we provide e-ticketing services (the “Services”).

Through the Services, EventPro provides a simple and quick means for registered users who are event Hosts, planners and charitable organizations (“Hosts”) to create event registration, and to sell E-tickets and registrations (or issue free registrations), to such events (including to free events) to those persons who are interested in attending such events (“Attendees”). We refer to Hosts, Attendees and other visitors and browsers of the Services collectively as “Users” or “you.”

2. Our Terms Of Use.

2.1 Application.

The following policy sets forth the terms and conditions upon which you may use the Services (the “Terms of Use”). By registering or using our site/apps or services, it will be deemed that you have accepted these Terms of use. IF YOU DO NOT ACCEPT THESE TERMS OF USE, PLEASE DO NOT REGISTER FOR OR USE ANY EventPro SERVICES. By accepting the Terms of Use and using the Services in any manner, you agree to these Terms of Use without modification and enter into a binding contract with EventPro. When you register, you agree to provide true, accurate and complete information. You agree to update this information as and when changes occur.

2.2 Incorporation By Reference.

These Terms of Use and the rights and obligations contained in these Terms of Use are in addition to and are incorporated into the Terms and Conditions by reference. Nothing in these Terms of Use shall be deemed to modify, waive, amend or rescind any other term of the Terms and Conditions.

3. Your Use Of The Services.

3.1 The Services.

EventPro hereby grants you a personal, non-exclusive, non-transferable, non sub-licensable (except to sub-Users registered via the Services), revocable (in accordance with Section 4 of the Terms and Conditions), limited right to access and use the Services solely for the purposes of (a) browsing the Services and searching for, viewing, registering for or purchasing tickets to an event that is registered on the Services; and/or (b) if you are a Host, creating event registration, with respect to, and promoting, managing, tracking, and collecting sales proceeds for, an event, in each case (i) in compliance with these Terms of Use and the Terms and Conditions; and (ii) to the extent permitted under all applicable local, state, provincial, national and other laws, rules and regulations.

Notwithstanding the foregoing, you shall not, and shall not permit anyone else to, directly or indirectly (A) copy, modify, reproduce, translate, localize, port or otherwise create derivatives of any part of the Services; (B) reverse engineer, disassemble, decompile or otherwise attempt to discover the source code or structure, sequence and organization of all or any part of the Services (except that this restriction shall not apply to the limited extent restrictions on reverse engineering are prohibited by applicable local, state, provincial, national or other law, rule or regulation); (C) rent, lease, resell, distribute, use the Services for timesharing, service bureau or other commercial purposes not contemplated by this paragraph or otherwise exploit the Services in any unauthorized or unintended manner; (D) remove or alter any proprietary notices or labels on or in the Services; or (E) engage in any activity that interferes with or disrupts the Services. Any rights not expressly granted in this paragraph are reserved.

3.2 Applications.

You may access and use the Services through our Applications. For clarity, any access to or use of the Services via the Applications and the Applications themselves shall be deemed to be part of the Services and subject to the Terms and Conditions and these Terms of Use. This right to access and use the Applications may be revoked in accordance with Section 4 of the Terms and Conditions and EventPro may discontinue or modify the Applications as set forth in Section 11 below.

4. EventPro’s Role.

4.1 Listing Service.

EventPro is not the host or owner of the events listed for sale or registration on the Services. EventPro provides the Services, which allow Hosts to list and promote their events, but all sales are made by the respective Host listed on the applicable event page. It is the Host’s sole obligation to ensure that any event page posting on the Services and the nature and conduct of the underlying event meet all applicable local, state, provincial, national and other laws, rules and regulations, and that the goods and services described in any event page posting are actually delivered in a satisfactory manner.

4.2 Fees.

Creating an account, listing an event and accessing the Services is free. We charge our fees only when you buy paid tickets or registrations. All descriptions of standard fees on the Services represent the standard fees that EventPro charges to ticket buyers. These fees may vary based on individual agreements between EventPro and certain Hosts. Hosts ultimately choose if these fees will be passed along to Attendees and shown as “Fees” on the applicable event page or absorbed into the ticket or registration price and paid by the Host out of ticket and registration gross proceeds. The fees charged to Attendees may include certain other charges, including without limitation, facility fees, royalties, taxes, processing fees and fulfilment fees. Therefore, the fees paid by Attendees for an event are not necessarily the same as those charged by EventPro to the applicable Host or the standard fees described on the Services to Hosts. In addition, certain fees are meant, on average, to defray certain costs incurred by EventPro, but may in some cases include an element of profit and in some cases include an element of loss. EventPro does not control (and thus cannot disclose) fees levied by your bank and/or credit card company, including fees for purchasing tickets and registrations in foreign currencies or from foreign persons. Be sure to check with your bank or Credit Card Company prior to engaging in a transaction to understand all applicable fees, credit card surcharges and currency conversion rates.

4.3 Refunds.

Because all transactions are between a Host and its respective Attendees, EventPro asks that all Attendees contact the applicable Host of their event with any refund requests. In the event that a Host has not responded to a refund request within two (2) business days or there is a dispute between a Host and an Attendee that cannot be resolved, either party may contact EventPro. EventPro may, in its discretion, attempt to mediate such dispute, however, EventPro will have no liability for (a) a Host’s failure to give refunds; (b) EventPro’s failure to mediate a dispute; or (c) EventPro’s decision if it does mediate the dispute.

5. Account, Password And Security.

5.1 Registration.

As part of certain registration processes on the Services, you will create an account or change or add information about your account. You agree (a) to provide true, accurate, current and complete information about yourself, or if you are using the Services on behalf of an entity, the entity, as prompted by each Service registration form (the “Registration Data”); and (b) to maintain and promptly update the Registration Data to keep it true, accurate, current and complete. In the event of any dispute between two or more parties as to account ownership, you agree that EventPro shall be the sole arbiter of such dispute in its discretion and that EventPro’s decision (which may include termination or suspension of any account subject to dispute) shall be final and binding on all parties. EventPro reserves the right to refuse service, terminate accounts, terminate your rights to use EventPro Services, remove or edit content, or cancel orders in its sole discretion.

5.2 Security.

You are responsible for maintaining the confidentiality of your password and account details, and are fully responsible for all activities that occur under your account, including without limitation, all actions by sub-users registered under your account. You agree to immediately notify EventPro of any unauthorized use of your password or account or any other breach of security.

5.3 Age Restrictions.

EventPro is concerned about the safety and privacy of children. For this reason, and to be consistent with the terms of use of any third party service providers used by EventPro, you must be at least eighteen (18) years of age, or the legal age of majority where you reside, to use the Services. Otherwise you may use the Services only with the involvement of a parent or guardian. In any event, you may not use the Services if you are under the age of thirteen (13).

6. Content.

6.1 Site Content.

You agree that all material, including without limitation information, data, text, editorial content, design elements, look and feel, formatting, graphics, images, photographs, videos, music, sounds and other content (collectively, “Content”), contained in or delivered via the Services or otherwise made available by EventPro in connection with the Services (collectively, “Site Content”) is protected by copyrights, trademarks, service marks, trade secrets or other intellectual property and other proprietary rights and laws. EventPro may own the Site Content or portions of the Site Content may be made available to EventPro through arrangements with third parties. The compilation of all Site Content included in or made available through the Services is the exclusive property of EventPro and is protected by copyright laws. Except as expressly authorized by EventPro in writing or in connection with your permitted use of the intended functionality of the Services, you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works of any Site Content, or post any Site Content on any other website or in a networked computer environment for any purpose. You shall use the Site Content only for purposes that are permitted by these Terms of Use and any applicable local, state, provincial, national or other law, rule or regulation. Any rights not expressly granted herein are reserved.

6.2 Your Content.

You acknowledge and agree that if you contribute, provide or make available any Content to the Services (“Your Content”), you hereby grant to EventPro a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, transferable, sub-licensable (through multiple tiers) right and license to access, use, reproduce, transmit, adapt, modify, perform, display, distribute, translate, publish and create derivative works based on Your Content, in whole or in part, in any media, for the purpose of operating the Services (including EventPro’s promotional and marketing services), and you hereby waive any and all moral right to use the name you submit with Your Content. Notwithstanding the foregoing, EventPro does not claim, and you do not transfer, any ownership rights in any of Your Content and nothing in these Terms of Use will restrict any rights that you may have to use and exploit Your Content outside of the Services. You represent and warrant that you have all the rights, power and authority necessary to grant the foregoing license, and that all Your Content (a) does not infringe, violate, misappropriate or otherwise conflict with the rights of any third party; (b) complies with all applicable local, state, provincial, national and other laws, rules and regulations; and (c) does not violate the Terms and Conditions, including without limitation these Terms of Use and the Privacy Policy. In addition, Your Content must be accurate and truthful. EventPro reserves the right to remove any of Your Content from the Services at any time if EventPro believes in its discretion that it violates the Terms and Conditions, including without limitation, these Terms of Use. In addition, you agree that EventPro may use your name and logo (whether or not you have made it available through the Services) for the purpose of identifying you as an existing or past customer of EventPro both on the Services and in marketing, advertising and promotional materials.

6.3 Feedback & Revisions.

You hereby acknowledge that (a) any and all suggestions for correction, change and modification to the Services and other feedback (including but not limited to quotations of written or oral feedback), information and reports provided to EventPro by you (collectively “Feedback”); and (b) all improvements, updates, modifications or enhancements, whether made, created or developed by EventPro or otherwise relating to Feedback (collectively, “Revisions”), are and will remain the property of EventPro. All Feedback and Revisions become the sole and exclusive property of EventPro and EventPro may use and disclose Feedback and/or Revisions in any manner and for any purpose whatsoever without further notice or compensation to you and without retention by you of any proprietary or other right or claim. You hereby assign to EventPro any and all right, title and interest (including, but not limited to, any patent, copyright, future copyright, trade secret, trademark, show-how, know-how and any and all other intellectual property right) that you may have in and to any and all Feedback and Revisions. You hereby agree to waive any moral rights you may have in any and all Feedback and Revisions, and consent to any act which amounts to an infringement of any such moral right, in favor of EventPro. At EventPro’s request, you will execute any document, registration or filing required to give effect to these provisions.

7. Conduct.

7.1 Certain Restrictions.

You understand that you are liable for all Content, in whatever form, that you provide or otherwise make available to or through the Services, including to other users of the Services. You agree not to use the Services to:

upload, post, email, transmit or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable;
harm minors in any way;
facilitate gambling, gaming, lotteries, raffles, contests, sweepstakes and/or any other activity featuring the award of a prize;
impersonate any person or entity, including, but not limited to, a EventPro representative, or falsely state or otherwise misrepresent your affiliation with a person or entity;
forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the Services;
upload, post, email, transmit or otherwise make available any Content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
upload, post, email, transmit or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright, right of publicity or personality, or other intellectual property or proprietary rights of any person or entity;
upload, post, email, transmit or otherwise make available any Content related to the sale or provision of goods and services other than the sale or provision of tickets and registrations to bona fide events listed on the Services and other goods and services being sold or provided in conjunction with such events;
upload, post, email, transmit or otherwise make available any Content that contains viruses or any other computer code, files or programs that interrupt, destroy or limit the functionality of or to otherwise interact with the Services in a manner not permitted by the Terms and Conditions (including without limitation these Terms of Use and the API Terms of Use);
interfere with or disrupt the Services or servers or networks connected to the Services, or disobey any requirements, procedures, policies or regulations of networks connected to the Services;
attempt to probe, scan or test the vulnerability of any EventPro server or network or breach any security or authentication measures, unless you are an authorized contractor of EventPro specifically engaged to provide such services;
attempt to avoid or circumvent any technological measure implemented by EventPro to protect the Services or Content on the Services, including without limitation, encryption technology used to protect sensitive personal information;
solicit any User to use a third party service that competes with EventPro;
advertise your event but complete sales independent of the Services in order to circumvent the obligation to pay fees related to the Services;
intentionally or unintentionally violate any applicable local, state, provincial, national or other law, rule or regulation, including without limitation laws and regulations regarding the sale of tickets;
resell tickets or registrations;
collect credit card number, expiration date or CSC code or any other credit card information;
collect social security or insurance number, financial account number, drivers’ license number, health information or other sensitive information required to be secured under applicable local, state, provincial, national or other law, rule or regulation or for which disclosure is required in case of a data breach without first obtaining EventPro’s prior written consent; or
stalk or otherwise harass any person or entity.

7.2 Certain Remedial Rights.

You acknowledge that EventPro does not pre-screen Your Content or the Content of any other User in connection with the Services, but that EventPro and its designees shall have the right (but not the obligation) to monitor, alter, edit or remove any of Your Content, in whole or in part, based on violations of the Terms and Conditions, including without limitation, these Terms of Use. If we believe that Your Content could be changed so as to not violate the Terms and Conditions, we will attempt to send you notice prior to taking any such action, provided, that if we must act immediately to comply with applicable local, state, provincial, national or other law, rule or regulation or to limit our liability, we may take such action without prior notice. You acknowledge and agree that EventPro may preserve Your Content and account information and may also disclose Your Content and account information if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to (a) comply with legal process; (b) respond to claims that any of Your Content violates the rights of third parties; (c) enforce or administer the Terms and Conditions, including without limitation, these Terms of Use; and/or (d) protect the rights, property and/or personal safety of EventPro, its users and/or the public, including fraud prevention. You understand that the technical processing and transmission of the Services, including Your Content, may involve transmissions over various networks and/or changes to conform and adapt to technical requirements of connecting networks or devices. You agree to such transmissions and changes.

8. Sub-domains.

EventPro may provide you with the right to use a sub-domain within the Site (e.g., sub-domain prefix.eventproapp.com) for a given event. All such sub-domains are the sole property of EventPro and we reserve the right to determine the appearance, design, functionality and all other aspects of such sub-domains. In the event EventPro provides you with a sub-domain, your right to use such sub-domain will continue only for so long as your event is actively selling on the Services and you are in compliance with the Terms and Conditions, including without limitation, these Terms of Use.

9. Referrals and Public Affiliate Marketing Program.

The additional terms and conditions relating to EventPro’s Host Referral Program are incorporated into these Terms of Use by reference.

10. Additional Services.

EventPro may, upon request, and for such fees as EventPro may establish from time to time in its sole discretion, provide additional services to you beyond the basic functionality of the Site and Applications, including without limitation, marketing and promotion services, leasing ticket scanning and other equipment, providing on-site entry management consultants to assist you with your event set-up and providing dedicated account management services. All such additional services, whether provided prior to, during or following your event, shall be deemed a part of the Services and subject to all the terms and conditions of the Terms and Conditions, including without limitation, these Terms of Use. Such additional services shall be set forth in additional terms and conditions or other written agreements between you and an authorized officer of EventPro, and shall set forth the applicable fees and the other terms and conditions relating to such additional services.

11. Service Modifications.

EventPro is a fully integrated mobile EventPro and events management platform. We are constantly evolving our products and services to better meet the needs of our entire user base. Because of this, we do not guarantee any set of product features or functionality and reserve the right at any time to, and from time to time may, modify, suspend or discontinue, temporarily or permanently, any part of the Services for any reason. Because you only pay fees to EventPro as you use the Services, there would be no refund of fees already due following any such change to the Services.

12. Links.

12.1 Third Party Websites.

The Services may provide, or Users may provide, links to other Internet websites or resources. Because EventPro has no control over such websites and resources, you acknowledge and agree that EventPro is not responsible for the availability of such websites or resources, and does not endorse and is not responsible or liable for any Content, advertising, products, services or other materials on or available from such websites or resources, or any damages or losses related thereto, even if such websites or resources are connected with EventPro partners or third party service providers.

12.2 Linked Accounts.

As part of the Services you may be able to link an account you have with a third party service, such as a social media website. By linking such third party account, you agree that EventPro may access, make available to and store any Content that you have provided to and stored in such third party account so that it is available on or through the Services. Such content may include personally identifiable information.

13. Privacy; Customer Information.

13.1 Privacy Policy.

All information provided by Users or collected by EventPro in connection with the Services is governed by EventPro’s Privacy Policy. The Privacy Policy is incorporated into the Terms and Conditions by reference. EventPro strongly recommends that you review the Privacy Policy.

13.2 Co-Ownership.

EventPro follows a “co-ownership model” with respect to Attendee Information (as defined below). This means that all Attendee Information inputted by an Attendee on event pages posted by an Host on the Services will be shared with the applicable Host and may also be used by EventPro in accordance with our Privacy Policy, including marketing or promotion of other events or services that may be of interest to the applicable Attendee. Note that Payment Data (as defined below) will not be shared with Hosts. Each Attendee acknowledges and agrees to this sharing and understands and agrees that each Host is solely responsible for the use of Attendee Information that was provided to such Host through the Services and that EventPro is responsible only for its own use of Attendee Information. Each Host represents, warrants and agrees that (a) it will at all times comply with all applicable local, state, provincial, national and other laws, rules and regulations with respect to Attendee Information; (b) it will at all times comply with any applicable policies posted on the Services with respect to Attendee Information; and (c) upon a request of a given Attendee or as permitted in Section 7.2 of these Terms of Use, EventPro is authorized at its discretion to delete or anonymize Attendee Information of a requesting Attendee from the Services at which time it will no longer be available to Host through the Services or will no longer be linked to an identifiable Attendee through the Services. However, Attendees should note that Attendee Information may still be available in the Host’s own databases if transmitted prior to EventPro receiving the underlying request. For purposes of this Section, “Attendee Information” means information about a given Attendee made available on or through the Services, including, without limitation, name, address, e-mail address, past event attendance, event interests, and phone numbers, but excluding Payment Data.

13.3 Payment Data.

EventPro will not share with a Host any Payment Data. “Payment Data” means any full payment card (Credit / Debit / Prepaid Debit) number or other full payment account number and the related expiration date and security code entered by an Attendee on the Services in order to purchase a ticket or registration.

14. Disclaimer
Services “AS IS”

TO THE FULLEST EXTENT PERMITTED BY LAW, EventPro AND ITS AFFILIATES, SUPPLIERS AND DISTRIBUTORS MAKE NO WARRANTIES, EITHER EXPRESS OR IMPLIED, ABOUT THE APP AND SERVICES. THE SERVICES ARE PROVIDED “AS IS.” WE ALSO DISCLAIM ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. EVENTPRO IS NOT LIABLE FOR ANY STATEMENTS, REPRESENTATIONS OR CONTENT PROVIDED BY ITS USERS IN ANY PUBLIC FORUM, PERSONAL HOME PAGE OR OTHER INTERACTIVE AREA, EVEN IF EventPro HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

EventPro does not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through the EventPro site/app or any hyperlinked site or featured in any banner or other advertising.

EventPro further does not warrant that its service will be secure or uninterrupted; the information, links or other items contained within these materials will be accurate and complete. EventPro may make changes to these materials at any time without notice. EventPro makes no commitment to update the Materials. No oral advice or written information given by EventPro, its employees, licensors or the like will create a warranty; nor may you rely on any such information or advice.

15. Limitation of Liability

As a condition of use of the App/Service, and in consideration of the services provided by EventPro, User agrees that neither EventPro, nor any officer, affiliate, director, shareholder, agent, contractor or employee of EventPro will be liable to User or any third party for any direct, indirect, incidental, special, punitive, or consequential loss of profits, loss of earnings, loss of business opportunities, damages, expenses, or costs resulting directly or indirectly from, or otherwise arising in connection with the Service, App/Site or Content.

EventPro SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER RESULTING FROM ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SERVICE/APP, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR APP, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH OUR SITE BY ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE EventPro APP/ SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL EventPro, ITS AFFILIATES, SUPPLIERS OR DISTRIBUTORS BE LIABLE FOR (A) ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, EXEMPLARY OR CONSEQUENTIAL DAMAGES OR ANY LOSS OF USE, DATA, BUSINESS, OR PROFITS, REGARDLESS OF LEGAL THEORY, WHETHER OR NOT EventPro HAS BEEN WARNED OF THE POSSIBILITY OF SUCH DAMAGES, AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE; (B) AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES SHALL NOT BE MORE THAN THE AMOUNTS PAID BY YOU TO EventPro, IF ANY, FOR THE PAST 12 MONTHS OF THE SERVICES IN QUESTION.

16. Termination

You’re free to stop using our Services at any time. We also reserve the right to suspend or end the Services at any time at our discretion and without notice. For example, we may suspend or terminate your use of the Services if you’re not complying with these Terms, or use the Services in a manner that would cause us legal liability, disrupt the Services or disrupt others’ use of the Services. We will of course provide you with notice via the email address associated with your account before we do so.

17. Waiver, Severability & Assignment

EventPro’s failure to enforce a provision is not a waiver of its right to do so later. If a provision is found unenforceable, the remaining provisions of the Terms will remain in full effect and an enforceable term will be substituted reflecting our intent as closely as possible. You may not assign any of your rights under these Terms, and any such attempt will be void. EventPro may assign its rights to any of its affiliates or subsidiaries, or to any successor in interest of any business associated with the Services.

18. Governing Law

These Terms shall be governed by and construed in accordance with laws of the Cayman Islands without regard to its choice of law provisions. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to these Terms. User hereby consents to personal jurisdiction of the courts located in the Cayman Islands

Consent
We explain what you’re consenting to clearly and without ‘legalese’, and ask that you explicitly consent to contact from us.

Breach Notification
In the event of a breach we will notify affected users within 72 hours of first having become aware of the breach.

Right to Access
Users can request confirmation as to whether or not personal data concerning them is being processed, where and for what purpose. Further, we shall provide a copy of the personal data, free of charge, in an electronic format.

Right to be Forgotten
Once we have compared your (the subjects’) rights to “the public interest in the availability of the data”, we may delete your personal data where you have requested this.

Data Portability
We allow you to receive the personal data concerning you, which we will provide in a ‘commonly used and machine readable format’ and you have the right to transmit that data to another ‘controller’.

Privacy by Design
We implement appropriate technical and organisational measures, in an effective way, in order to meet the requirements of this Regulation and protect the rights of data subjects’. We hold and process only the data absolutely necessary for the completion of our duties (data minimisation), as well as limiting the access to personal data to those needing to act out the processing.

20. PRO POINTS – Member Rewards Program

20.1 Overview
EventPro offers a Member Rewards Program (“PRO POINTS”) to eligible Users for select purchases made through the Services. Participation in PRO POINTS is voluntary and subject to the following terms, which may be amended at EventPro’s discretion. By earning or redeeming PRO POINTS, you agree to be bound by these terms.

20.2 Earning Points
Users will earn 100 PRO POINTS for every $1.00 USD (or local equivalent) spent on eligible ticket purchases, unless otherwise specified. One PRO POINT is equal to $0.0001 in redemption value, representing 1% back in value. PRO POINTS are awarded solely for eligible transactions and are not legal tender.

20.3 Redemption & Restrictions
PRO POINTS can only be redeemed through the EventPro platform toward future ticket purchases, subject to any minimum point thresholds that may apply. You may not accumulate more than 100,000 PRO POINTS without redeeming; excess points may be forfeited at EventPro’s discretion.

20.4 Expiration
All PRO POINTS will automatically expire 547 days (approximately 18 months) from the date they are earned if not redeemed. Expired points cannot be reinstated under any circumstance.

20.5 Ineligible Transactions
Points will not be earned on:

Ticket purchases made less than seven (7) calendar days prior to the event date. Advance purchases are required to earn points.
Tickets sold under a reduced fee structure, including but not limited to charity events, fundraising events, or other specially designated ticket categories.
Fees, taxes, refunds, cancelled events, or fraudulent transactions.

20.6 Modifications and Termination
EventPro reserves the right to modify, suspend, or terminate the PRO POINTS program at any time, with or without notice. In the event of termination, unused points may be forfeited without compensation. Accumulated points have no cash value and may not be transferred, sold, or exchanged.

I acknowledge and agree that all ticket purchases, including ticketing, service, processing, and other fees, are final and non-refundable to the maximum extent permitted by applicable law, regardless of whether the ticket is used, unused, scanned, checked in, or not checked in.
